Guest Accommodation Agreement

1. Introduction & Acceptance

These Terms and Conditions (“Terms”) govern all bookings, stays, and use of the property and services of the Valhalla Cabin. Co. dba The Valhalla Inn (“the Inn,” “we,” “us,” or “our”), located at 509 Slocan Ave, British Columbia V0G 1S0 Canada. By making a reservation, checking in, or otherwise using our accommodation and services, the person booking and each guest staying (“you,” “Guest”) agrees to be bound by these Terms.

These Terms are governed by the laws of British Columbia and, where applicable, the laws of Canada, including the Hotel Keepers Act (RSBC 1996, c. 206), the Business Practices and Consumer Protection Act (RSBC 2004, c. 2) (“BPCPA”), the Personal Information Protection Act (RSBC 2003, c. 63) (“PIPA”), and the BC Human Rights Code (RSBC 1996, c. 210).

2. Definitions

  • “Booking” or “Reservation” means a confirmed request to stay at the Inn for specified dates, made directly with us or through a third-party booking channel.
  • “Guest” means any individual who books, occupies, or accompanies a booking for a room or unit at the Inn.
  • “Rate” means the price quoted for accommodation, exclusive of applicable taxes and fees unless stated otherwise.
  • “Property” means the buildings, grounds, furnishings, and equipment of the Inn.

3. Reservations & Booking

Reservations may be made online, by phone, or by email. A reservation is confirmed only once you receive written confirmation from us and, where required, we have received a valid deposit or payment card guarantee. The person making the booking must be at least 19 years of age and confirms they have authority to book on behalf of all named Guests.

A valid credit card and government-issued photo ID may be required at check-in to verify identity and secure incidental charges. We collect and retain a minimal guest register as required under the Hotel Guest Registration Act (RSBC 1996, c. 206) — see Section 11 (Privacy) for how this information is used.

4. Rates, Deposits & Payment

Rates are quoted in Canadian dollars and are subject to applicable taxes, including GST and the Municipal and Regional District Tax (MRDT), unless stated as tax-inclusive. We accept the following payment methods: Visa/Mastercard, debit, e-transfer, and cash). For reservations made within 7 days of your arrival date, the full amount of your stay will be charged at the time of booking. These reservations are non-refundable, including in the event of cancellation or changes to your reservation.

We do not add undisclosed fees to your total; any additional fees will be clearly stated before you complete your booking, consistent with BC’s requirements for clear and transparent contract terms.

5. Cancellation, Changes & Refunds

Cancellations made at least 7 days before the scheduled check-in date will receive a full refund of any deposit paid. For example, if your check-in date is the 15th of the month, you may cancel without penalty any time up to and including the 8th of that month. Cancellations made within 7 days of check-in, no-shows, and early departures are not entitled to any refunds.

Special, promotional, corporate, and group rate bookings: as set out in the Group Rate Addendum (Appendix A), which takes precedence for that booking.

Changes to dates or room type are subject to availability and may result in a rate adjustment. While we will note guest preferences, we cannot guarantee a specific room. Any future-stay credit issued in lieu of a refund will state its value and expiry clearly in writing.

We strongly recommend purchasing travel cancellation/interruption insurance in the event of unforeseen changes to your travel plans.

6. Check-In & Check-Out

Check-in time is 3:00 p.m. and check-out time is 11:00 a.m. Early check-in or late check-out is subject to availability and may incur an additional charge. Guests who fail to vacate by check-out time without prior arrangement may be charged for an additional night.

7. Occupancy & House Rules

Maximum occupancy per room is stated at time of booking and may not be exceeded without prior approval. Guests under the age of 19 must be accompanied by an adult.

8. For Your Care & Comfort

The Valhalla Inn’s “For Your Comfort & Care” guide, provided at check-in and posted in each guest room, covers additional practical matters such as in-room appliances, fire safety, pets, smoking, alcohol, guest Wi-Fi/internet use, parking and plumbing/septic care. This guide is incorporated into and forms part of these Terms, and a breach of it is treated as a breach of these Terms, including for purposes of Section 14 (Right to Refuse or Terminate Service).

9. Guest Responsibility & Indemnification

Guests are responsible for their own actions and for the actions of any members of their party or visitors during their stay.

The guest agrees to be responsible for and to reimburse the Inn for any loss, damage, or reasonable costs incurred as a result of the guest’s, their party’s, or their visitors’ negligent, intentional, or unauthorized acts, including damage to the Inn, its furnishings, fixtures, equipment, or property.

This includes, but is not limited to, damage resulting from unauthorized smoking, misuse of Inn property or facilities, or actions that cause damage beyond ordinary wear and tear.

The guest agrees to indemnify and hold the Inn harmless from third-party claims, losses, or reasonable expenses arising directly from the guest’s or their party’s negligent, intentional, or unauthorized conduct during their stay.

Nothing in these Terms and Conditions is intended to limit or exclude any rights or protections that cannot legally be limited or excluded under applicable law.

10. Liability & Guest Property

Under the Hotel Keepers Act (RSBC 1996, c. 206), the Inn’s liability for loss of or damage to a guest’s goods or property brought to the Inn is limited by law, except where the loss or damage results from the wilful act, default, or neglect of the Inn or its staff, or where the property was expressly deposited with us for safe custody.

To the fullest extent permitted by law, the Inn is not liable for indirect, incidental, or consequential loss arising from a stay, except where such liability cannot be excluded under the Business Practices and Consumer Protection Act or other applicable law. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded, including liability for death or personal injury caused by our negligence.

11. Lien for Unpaid Charges

As permitted under the Hotel Keepers Act, the Inn has a lien on a guest’s baggage and property for unpaid accommodation and food charges, and may retain such property, and ultimately sell it in accordance with the Act’s notice requirements, to recover amounts that remain unpaid.

12. Privacy of Personal Information

We collect, use, and disclose personal information (such as your name, contact details, ID, and payment information) only as necessary to process your booking, meet legal registration requirements, provide services you request, and improve our operations, in accordance with the BC Personal Information Protection Act (PIPA).

We will notify affected individuals and the Office of the Information and Privacy Commissioner for BC of any breach of personal information that creates a real risk of significant harm, as required by PIPA. Questions about your personal information may be directed to info@valhallainn.biz.

13. Video Surveillance

Video cameras operate in certain common areas of the Property (such as entrances, hallways, and parking areas) for the safety and security of guests, staff, and the Property, as permitted under PIPA. Notices are posted at the entrances to areas under video surveillance. Cameras are not used in guest rooms, washrooms, or other areas where guests have a reasonable expectation of privacy. Footage is stored securely, access is limited to authorized personnel, and footage is retained only as long as reasonably necessary before being securely deleted.

14. Guest Reviews & Fair Contract Terms

We do not restrict, penalize, or require pre-approval of a guest’s honest review of their stay on any platform. Nothing in these Terms requires you to resolve a dispute only through private arbitration or prevents you from participating in a class proceeding, in accordance with 2025–2026 amendments to the BPCPA governing unfair contract terms.

15. Force Majeure

We are not liable for a failure to provide accommodation or services caused by events beyond our reasonable control, including natural disaster, wildfire, extreme weather, power or water outage, government order, labour disruption, or public health emergency. Where such an event affects a confirmed booking, we will offer a rebooking or credit where reasonably possible.

16. Right to Refuse or Terminate Service

We may decline a reservation, refuse check-in, or end a stay without refund where a guest:

  • is intoxicated, disorderly, or engaging in conduct that endangers the safety of others, in accordance with the Hotel Keepers Act;
  • causes or threatens serious damage to the Property;
  • brings onto the Property an item that poses a genuine safety risk to others;
  • engages in unlawful activity on the Property; or
  • materially breaches these Terms or a clearly posted house rule, including after a prior warning.

We will never refuse or terminate accommodation or service on the basis of a characteristic protected under the BC Human Rights Code, including race, colour, ancestry, place of origin, religion, family or marital status, physical or mental disability, sex, sexual orientation, gender identity or expression, or age (except where another law permits an age-based distinction, such as refusing alcohol service to a person under 19).

17. Governing Law & Disputes

These Terms are governed by the laws of British Columbia and applicable federal laws of Canada. Any dispute may be brought before the courts of British Columbia or, where the amount in dispute qualifies, the Civil Resolution Tribunal. Nothing in this section requires mandatory private arbitration or waives your right to participate in a class proceeding.

18. Changes to These Terms

We may update these Terms from time to time; the version in effect on the date of your booking will apply to your stay. Material changes will be posted at www.valhallainn.biz with an updated effective date.
